These Terms of Use constitute a legally binding agreement between you and NEAL AVIONICS, referred to as “we,” “us,” or “our.”
By accessing the website, creating an account, submitting an order, or otherwise using our website or services, you agree to these Terms of Use and the policies incorporated into them.
If you do not agree to these terms, do not use the website or submit an order.
1. Acceptance of these terms
These Terms of Use apply to all visitors, customers, prospective customers, account holders, and other users of this website. They apply to website access, customer accounts, product inquiries, online purchases, communications, reviews, and other services made available through the website.
Certain products, transactions, installations, services, warranties, special orders, commercial accounts, or financing arrangements may be subject to additional written terms. When additional terms conflict with these Terms of Use, the more specific terms control for that particular transaction.
Our Privacy Policy, Return Policy, Shipping Policy, product-page disclosures, order confirmations, and other policies referenced on the website are incorporated into these Terms of Use.
2. Eligibility and authority
You must be at least 18 years old and legally capable of entering into a binding agreement to place an order or create an account.
If you use the website or submit an order on behalf of a company, aircraft owner, operator, repair station, government agency, or other organization, you represent that you are authorized to bind that organization to these terms.
You may not use this website where doing so would violate applicable law, regulation, sanction, export restriction, or contractual obligation.
3. Customer accounts
Certain website features may require a customer account. When creating or using an account, you agree to provide current, accurate, and complete information.
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- Restricting access to your account and devices.
- All orders and activities conducted through your account, except to the extent caused by our failure to use reasonable security measures.
- Promptly notifying us through our Contact Us page if you suspect unauthorized access or use.
We may suspend or terminate an account when reasonably necessary to protect customers, prevent fraud, investigate misuse, comply with law, or enforce these terms.
4. Product information and availability
We make reasonable efforts to present accurate product descriptions, photographs, specifications, pricing, stock status, compatibility information, and manufacturer information. Product information may nevertheless contain typographical errors, omissions, outdated information, or inaccuracies.
Product photographs are illustrative. Colors, finishes, packaging, included accessories, labels, hardware, software screens, and other details may differ from the product delivered because of lighting, display settings, manufacturing changes, software revisions, or manufacturer substitutions.
Manufacturers may revise product designs, specifications, software, documentation, compatibility, pricing, or included components without prior notice. We may correct or update website information at any time.
Displaying a product on the website does not guarantee that the product is in stock, immediately available, suitable for a particular application, or available at the displayed price.
5. Aviation products and installation
Aviation products may be subject to aircraft-specific eligibility, approved-model-list requirements, Supplemental Type Certificates, Technical Standard Orders, Parts Manufacturer Approvals, installation manuals, service bulletins, airworthiness directives, software requirements, configuration requirements, and federal or local aviation regulations.
Certified and experimental aircraft
A product suitable for an experimental aircraft may not be approved for installation in a type-certificated aircraft. Similarly, a product approved for one aircraft model, configuration, or intended function may not be approved for another.
Product-page language such as “certified,” “experimental,” “approved,” “compatible,” “replacement,” or “fits” must be read together with current manufacturer documentation, approved model lists, limitations, installation instructions, and applicable regulatory approvals.
Customer responsibility
Before purchasing, installing, configuring, or operating an aviation product, you are responsible for confirming:
- Aircraft make, model, serial number, configuration, and eligibility.
- Whether required approvals, installation data, licenses, subscriptions, antennas, sensors, harnesses, adapters, mounting hardware, or accessories are included.
- Whether the intended installation requires an appropriately certificated mechanic, repair station, avionics technician, inspector, or other qualified professional.
- Whether the product satisfies applicable FAA requirements and any other governing aviation authority.
- Whether software, databases, firmware, subscriptions, or activation services are required.
Installation and operation
Aviation products must be installed, configured, inspected, tested, maintained, and operated in accordance with current manufacturer instructions, approved technical data, aircraft documentation, and applicable law.
Unless we expressly agree in a separate written service agreement, the online sale of a product does not include installation, engineering, aircraft inspection, certification, return-to-service approval, regulatory approval, database subscriptions, software activation, or technical support beyond the support expressly described for that product.
Pilots, owners, operators, installers, and maintenance personnel remain responsible for aircraft airworthiness, preflight inspection, legal operation, equipment limitations, database currency, and compliance with all applicable operating rules.
6. Orders and order acceptance
Your submission of an order is an offer to purchase the products listed in the order. An automated order confirmation only confirms that we received the order; it does not necessarily constitute acceptance.
We may accept an order by shipping the product, providing an express acceptance, beginning an authorized special-order process, or otherwise confirming acceptance.
We may decline, limit, hold, or cancel an order when:
- A product is unavailable or discontinued.
- Pricing, product information, or inventory is incorrect.
- Payment cannot be authorized or verified.
- Fraud, misuse, resale abuse, or unlawful activity is suspected.
- The order presents export-control, sanctions, safety, or compliance concerns.
- We cannot reasonably verify aircraft eligibility or other information necessary to process the order.
- Shipping restrictions prevent delivery to the requested address.
If we cancel an order after collecting payment, we will issue an appropriate refund to the original payment method, subject to ordinary payment-processing times.
Quantity limitations and resale
We may limit quantities per customer, household, account, aircraft, organization, payment method, or order. Products are offered for lawful end use and legitimate business use. Unauthorized resale, diversion, or export is prohibited.
Special orders and backorders
Special-order, configured, programmed, serialized, activated, custom, cut-to-length, or non-stock products may be subject to separate cancellation and return restrictions disclosed before purchase or in our Return Policy.
Manufacturer availability dates, backorder dates, and estimated delivery dates are estimates and may change.
7. Pricing, taxes, and payment
Prices are displayed in United States dollars unless otherwise stated. Prices may change without notice before an order is accepted.
Applicable sales tax, use tax, shipping, freight, insurance, handling, hazardous-material charges, customs charges, duties, brokerage fees, installation charges, subscriptions, software licenses, and other fees may be added when applicable and will be disclosed during checkout or through a separate quotation when reasonably possible.
You authorize us and our payment processors to charge the payment method provided for the total amount shown at checkout and for any separately approved charges.
You represent that you are authorized to use the submitted payment method and that all payment and billing information is accurate.
Pricing errors
If a product is listed at an incorrect price because of a typographical, technical, supplier, currency, inventory, or system error, we may cancel the affected order before shipment. We will notify you and refund any amount already collected for the canceled item.
Recurring charges
We will not enroll you in a subscription or automatic renewal program unless the recurring terms are clearly disclosed before purchase and you affirmatively agree to them.
Any recurring product, database, software, service, or subscription will be governed by the cancellation and renewal terms presented when you subscribe.
8. Shipping, delivery, and risk of loss
Shipping, processing, freight, delivery, address-correction, signature, inspection, and related terms are governed by our Shipping Policy and any shipping information displayed during checkout.
Processing and delivery dates are estimates unless we expressly agree to a guaranteed date in writing. Delays may occur because of manufacturer availability, carrier disruptions, weather, natural disasters, security screening, fraud review, regulatory restrictions, labor disruptions, customs, supply-chain conditions, or events outside our reasonable control.
You are responsible for providing a complete and accurate shipping address and for ensuring that an authorized person can receive and inspect the shipment.
Unless otherwise stated or required by law, risk of loss passes to you when the shipment is delivered to the address provided in the order. Commercial, freight, international, and separately quoted transactions may be subject to different written shipping terms.
Inspection of deliveries
Inspect packages promptly after delivery. Visible freight or shipping damage should be noted with the carrier at delivery and reported to us through the Contact Us page as soon as reasonably possible.
Retain all packaging, labels, photographs, serial-number information, and damaged components until the carrier or seller confirms that they may be discarded.
9. Returns, cancellations, and refunds
Returns, exchanges, cancellations, restocking fees, return shipping, nonreturnable products, special orders, damaged products, and refund timing are governed by our Return Policy.
The Return Policy in effect when your order is placed generally applies to that order unless applicable law requires otherwise.
A return authorization does not guarantee a refund. Returned products may be inspected for condition, completeness, serial number, installation, activation, alteration, damage, missing components, and compliance with return requirements.
Nothing in these terms limits a nonwaivable remedy for defective goods, breach of warranty, misdelivery, or another right provided by applicable law.
10. Product warranties
Products may include warranties offered by their manufacturer. Manufacturer warranties are governed by the manufacturer’s current written warranty terms, limitations, registration requirements, and claim procedures.
We do not expand or modify a manufacturer warranty unless we expressly provide a separate written warranty signed or issued by us.
Warranty coverage may be affected by installation, misuse, accident, unauthorized repair, modification, improper configuration, electrical damage, environmental exposure, outdated software, failure to follow instructions, missing proof of purchase, serial-number alteration, or use outside the product’s approved purpose.
Some warranty claims require evaluation or authorization by the manufacturer. We do not control the manufacturer’s eligibility decision, repair method, replacement decision, processing time, parts availability, or warranty reimbursement.
11. Product safety, warnings, and recalls
You agree to read and follow all product instructions, warnings, labels, manuals, service bulletins, installation requirements, operating limitations, and safety notices.
Certain products may expose users to electrical hazards, chemicals, batteries, fuel, moving components, high temperatures, pressurized systems, radio-frequency energy, hazardous materials, or other risks. Products must be handled, transported, stored, installed, and disposed of appropriately.
Product pages may include warnings required by California Proposition 65 or other laws. A warning does not necessarily mean that a product is unsafe when used as directed.
If a product is subject to a safety notice, service bulletin, or recall, stop using it when instructed and follow the manufacturer’s or government agency’s directions.
12. Export controls and restricted destinations
Products, software, technical information, encryption technology, navigation equipment, communications equipment, and other items offered on the website may be subject to United States export-control and sanctions laws.
You agree not to export, re-export, transfer, release, sell, divert, or use a product in violation of applicable export, sanctions, anti-boycott, customs, or import laws.
You represent that:
- You are not located in, organized under the laws of, or ordinarily resident in a prohibited destination.
- You are not listed on a restricted-party or denied-person list.
- Products will not be used for a prohibited end use.
- You will obtain all licenses, approvals, and authorizations required for export, import, transfer, or use.
We may request end-user, destination, aircraft, organization, or compliance information before processing an order and may refuse a transaction presenting a compliance concern.
13. Prohibited conduct
You may not use the website to:
- Violate any law, regulation, court order, or legal right.
- Submit fraudulent, deceptive, inaccurate, or misleading information.
- Impersonate another person or falsely represent your authority.
- Obtain products for an unlawful, prohibited, sanctioned, or unauthorized end use.
- Interfere with website operation, security, availability, or performance.
- Introduce malware, malicious code, automated attacks, or harmful material.
- Attempt to gain unauthorized access to accounts, systems, databases, servers, or networks.
- Scrape, harvest, crawl, copy, or extract website information through automated means except as permitted by law or with our written permission.
